So maybe

	fcreate_or_truncate(const char *path)
	{
		 FILE *ret = fopen(path, "w");

		 if (!ret && errno == EPERM) {
			 if (!unlink(path))
				 ret = fopen(path, "w");
			 else
				 errno = EPERM;
		 }
		 return ret;
	 }
